BIRP.fm is run by Josh Blalock in France. These are the terms for using the site, sending a track, and supporting it. They are short because the site is simple. Questions go to [email protected].
Listening
The playlists are free to stream and always will be. The music belongs to the artists and labels who made it, and it plays through the services that host it. The write-ups, artwork and the site itself are BIRP.fm's. Enjoy it, share links to it, and don't scrape it, copy it wholesale, or do anything that gets in the way of other people using it.
Accounts
One account per person, with a working email address. You are responsible for what happens under your password. You can delete your account from your profile page at any time. An account used to spam, harass, or break the law can be closed without notice.
Comments and chat
Be decent. No spam, no harassment, nothing illegal, nothing that isn't yours to post. Anything can be removed and anyone can be banned, without a debate. What you write stays yours; by posting it you let BIRP.fm show it on the site.
Sending a track
A paid submission buys one thing: a full listen and a written response within 48 hours. It does not buy a place on the playlist, and no amount of money will. If the track is passed on, the response says why, in at least 20 words. If no response arrives within 48 hours, the fee is refunded automatically, to your card if you paid by card and to your credit balance if you paid with a credit.
Credits never expire and can be spent on any track at any time. They are tied to your account and can't be transferred or exchanged for cash. If a payment for credits is refunded or disputed, the credits it bought are removed, and a balance that has already been spent goes negative until it is topped up.
Once a response has been sent, the review has been delivered and the fee is not refundable. The response is one person's honest opinion about one month's playlist, and it is sent to you alone.
You must own or control the rights to any track you send, and you promise that you do when you submit. If a track is accepted, you give BIRP.fm permission to feature it: to name the artist and track, show its artwork, link to it, write about it, and include it in the month's playlist on the site and on the streaming services BIRP.fm publishes to. That permission lasts as long as the track stays up. If you ever want it taken down, email and it will be.
Supporting the site
Support is a gift, not a purchase. Monthly support renews until you cancel, which you can do at any time from the manage link on the support page; you are not charged again after you cancel, and the month already paid for isn't refunded. A one-time gift keeps your heart for 12 months. Gifts are refunded only if something went wrong, such as a duplicate charge, which you can raise by email.
The heart and the mention on the support page are a thank-you. They can change over time. Nothing on the site is, or will be, locked away from people who don't support it.
Other people's services
Payments run through Stripe, and tracks play through YouTube, SoundCloud, Spotify and the other services that host them. Each has its own terms, and using them through BIRP.fm means agreeing to those too.
Taking something down
If you hold the rights to something on the site and want it removed, email [email protected] with a link to it. Genuine requests are acted on quickly and without argument.
The usual
The site is provided as it is. It is one person's project, and it may be down, change, or go away. To the extent the law allows, BIRP.fm isn't liable for losses that come from using it or from being unable to. Nothing here takes away the rights you have as a consumer under the law where you live. These terms are governed by French law.
